Manningham Council has partnered with FOCUS Consultants to deliver governance training to women in sport within Manningham.

This workshop will provide an opportunity for women to gain skills and insights to support their journey to become influential leaders, board or committee members. It will also provide the opportunity to network with other like minded administrators in a safe and supported environment.

This training is suitable for women who have either recently joined a board or a committee, or women who are looking to take on a board or committee position within the sport and recreation sector.

This workshop has been made possible by the 2021-22 Change Our Game Community Activation Grants Program.

Request freedom of information
… many documents in our possession. Tags About Council Governance … Request freedom of information …

The Freedom of Information Act 1982 (‘FOI Act’) provides a general right of access to documents held by Manningham Council.

You can request access to:

  • documents about your personal affairs, regardless of the age of the documents
  • any other documents which were created on or after 1 January 1989.

Before submitting a Freedom Of Information (FOI) application

  1. Check if the documents are publicly available

Check if  you can get the documents or information you need through Council or other agencies.

  2. Search our website

Search our website to see if the information you seek is available. Contact us if you can't find what you are looking for.

  3. Read our Freedom of Information (FOI) Part II statement

The Freedom of Information (FOI) Part II statement provides you with:

    • a summary of Council’s powers and functions

  4. Contact the Freedom of Information Officer

If you still cannot locate the information you seek, contact the Freedom of Information Officer at FOI@manningham.vic.gov.au.

In some instances, we may be able to provide you with the information you seek without going through the formal process.

Please note: If you need documents for a court hearing or litigation, speak to your legal adviser about other methods available to gain access in those circumstances.

How to make a FOI request

All FOI requests must be in writing.

You can submit a FOI request yourself, or you can authorise someone (e.g. a solicitor) to make the request on your behalf.

It is important that you provide an accurate description of the documents you are seeking to access. Requests must be for specific documents or groups of documents, not 'all documents' in a broad category. Try to identify a relevant timeframe and the type/s of documents you seek access to.

Your application must include:

  • a clear description of the documents you seek access to
  • a non-refundable application fee of $32.70 (from 1 July 2024), or
  • proof that you qualify to have the application fee waived, such as a current pension card or health care card in your name
    • we can provide an invoice for electronic and online payments
  • proof of your identity, such as drivers’ licence, if the documents are about your personal affairs
  • your written authorisation if a legal firm is submitting the request on your behalf
  • your contact details, including telephone number and email address. We may need to contact you if we have any queries about your application.

While not mandatory, you can use our FOI application form as a guide.

How long does it take to process a FOI request?

Council has 30 days from the date of receiving a valid request to decide on whether to release the documents.

Please note: the decision timeframe outlined above may change or be extended as we process your request. This may occur for the following reasons:

  • under section 21 of the FOI Act, the time period may be extended
    • an additional 15 days if it is determined that mandatory third-party consultation is required when considering certain exemptions under the FOI Act
    • up to an additional 30 days with your agreement
  • if it is determined under section 22 of the FOI Act, that you are required to pay an access charges deposit, on account of the access charges estimate being $50 or more
    • payment of this deposit will reset the initial 30-day timeframe, restarting it from the day on which the deposit payment is received by us.

We will notify you if there is a change to the decision timeframe and the reasons for it.

Are there documents that can’t be requested?

The FOI Act outlines certain exceptions and exemptions where Council may refuse access to certain information contained in documents. These documents are often referred to as 'exempt documents'.

We will review any requested documents and decide if the information contained in the documents can be released. In some cases, we may refuse access to an entire document or give you access to a document with the exempt information deleted.

Examples of exemptions include:

  • internal working documents, where it would be against public interest to disclose
  • law enforcement documents
  • documents covered by legal privilege (e.g., legal advice)
  • documents containing personal information of other people
  • documents containing information provided to Council in confidence
  • documents containing information from a business
  • documents covered by secrecy provisions in other legislation.

If we decide to refuse access to some or all documents, we will tell you about that decision and the reasons why. We will also tell you of your review rights.

Ask for a review

You must request a review within 28 days of receiving the decision letter.

If you are not satisfied with our decision on access, you can ask for a review. You can do this by contacting the Office of the Victorian Information Commissioner.

You can ask for a review in any of the following ways:

Local Government Act 2020

Local Government in Victoria is administered under the Local Government Act 2020, which provides a framework for the establishment and operation of councils.

The Act is the main legislative instrument for Victoria's seventy-nine councils.

Part 1A of the Local Government Act contains the Local Government Charter, which describes the purpose, objectives and functions of council.

In addition to these matters, the Local Government Act also includes provisions for:

  • entitlements for residents and ratepayers to vote in council elections
  • the conduct of local council elections, nominations and vote counting
  • independent Electoral Representation Reviews by an electoral commission
  • council governance requirements, including codes of conduct and disclosure of conflicts of interest
  • council decision making, including records of meetings, confidentiality and limits on decisions during election periods
  • levying and payment of council rates and charges
  • preparation of Council Plans, budgets and annual reports
  • council's powers to make and enforce local laws.

Community Local Law

Manningham’s Community Local Law 2023 is a local law made under Part 3 of the Local Government Act 2020 and section 42 of the Domestic Animals Act 1994.

This Local Law is made in recognition of Manningham’s Generation 2030 Community Plan and the Council Plan, which, as Council’s overarching strategic documents, provide a long-term shared vision for Manningham and the community by guiding the development of policy and strategies.

The Victorian Charter of Human Rights and Responsibilities Act 2006 is a law that protects the human rights of all people in Victoria.

The Charter requires all public authorities and their employees to act compatibly with human rights in the delivery of services and when making decisions.

Manningham City Council recognises and respects that everyone has the same human rights entitlement to allow them to participate in, and contribute to, society and our community. We recognise that all persons have equal rights in the provision of, and access to, Council services and facilities. We also recognise that, at times, such rights may be limited, insofar as to strike a balance between individual rights and the protection of public interest.

Public Interest Disclosures Procedures

The Public Interest Disclosures Act 2012 (the Act) facilitates the making of public interest disclosures about improper conduct within the public sector without fear of reprisal. The Act aims to ensure openness and accountability by encouraging people to make disclosures and protecting them when they do.

Manningham is committed to the aims and objectives of the Act and encourages the making of disclosures about improper conduct. Council will not tolerate improper conduct by the organisation, its workers or Councillors nor the taking of reprisals against anyone who discloses such conduct.

What is a public interest disclosure?

Public Interest Disclosures (PID) are reports about:

  • Improper conduct of public bodies or public officers (such as corrupt conduct).
  • Detrimental action that a public body or public officer has taken against a person in reprisal for them (or another person) having made a PID or cooperating with the investigation of a PID.

A person making a disclosure must believe, on reasonable grounds, that the Council, worker or Councillor has engaged in, or proposes to engage in, improper conduct.

How do I make a public interest disclosure?

A PID may only be made by a natural person or a group of people making a joint disclosure. A PID cannot be made by a company or organisation.
We can only address disclosures that relate to Manningham City Council and its workers. A person making a disclosure can do so by contacting Council or the Independent Broad-based Anti-Corruption Commission (IBAC).

Council recommends that a written disclosure is sealed in an envelope and clearly marked:

  • “Private and Confidential – Attention Mr Andrew McMaster, Chief Legal and Governance Officer”.
  • Or by email to Andrew McMaster: andrew.mcmaster@manningham.vic.gov.au.

If your disclosure is about a Councillor, your disclosure must be made to the IBAC or the Victorian Ombudsman.

How will Manningham protect me if I make a disclosure?

Manningham will take all reasonable steps to protect a person who makes a public interest disclosure. All correspondence, phone calls and emails from a discloser will be referred to the Public Interest Disclosure Coordinator.

The Public Interest Disclosure Coordinator will take all necessary steps to ensure that the identity of the discloser and the person who is the subject of the disclosure are kept confidential. Where appropriate welfare support will also be provided.

Who can I contact if I am thinking about making a public interest disclosure?

Anyone considering making a disclosure is encouraged to read Manningham’s Public Interest Disclosure Procedures on this page. The procedures will guide you through the process and help you understand how to make a disclosure and activate the protections available under the Act.

Disclosures to Manningham Council

Disclosures to Manningham should be made confidentially to the Public Interest Disclosure Coordinator or to one of the Public Interest Disclosure Officers listed below:

  • Carrie Bruce, Senior Governance Lead, telephone 9840 9210
  • Vicki Miller, Risk and Assurance Lead, telephone 9840 9204

Disclosures to the IBAC

Disclosures can also be made directly to the IBAC.

  • Address: Level 1, North Tower, 459 Collins Street, Melbourne 3001
  • Telephone: 1300 735 135
  • Online: You can also submit an online complaint at the IBAC website

Disclosures about Councillors

Disclosures about Councillors must be made directly to the Victorian Ombudsman

  • Telephone: 9613 6222 or toll free to 1800 806 314
  • Online: You can also submit an online complaint at the Victorian Ombudsman website

Alternatives to making a public interest disclosure

The Public Interest Disclosures Procedures are designed to complement normal methods of submitting a complaint to Council and existing communication channels between workers and line managers. If your complaint does not meet the threshold of a public interest disclosure, it will be referred through to the appropriate person for action.

Need more information?

You can find more information about public interest disclosures in the Guidelines for handling public interest disclosures on the IBAC website.

Manningham’s Public Interest Disclosures Procedures have been prepared in accordance with these guidelines and advice from the IBAC.

Please contact the Council’s Protected Disclosure Coordinator on 9840 9360 for further information or a confidential discussion. Advice can also be received from IBAC on a confidential basis.

Townhouse and Low-Rise Code

Details on the new changes to the assessment of unit, townhouse and low-rise apartment developments  implemented by the Victorian Government from 6 March 2025....

Amendment VC267 was gazetted by the Minister for Planning on 6 March 2025.

From March 6, 2025, any new applications for units, townhouses, and apartment buildings up to three storeys must follow the new code.

The Townhouse and Low-Rise Code introduces a new way to assess these applications.

Where do these standards apply?

Within Manningham, the new code standards apply to residential development applications within the General Residential Zone, and Residential Growth Zones.

If a development site is subject to other overlays, the relevant decision guidelines of applicable overlays must still be considered in addition to the standards of the code.

Check if overlays apply to a property

  • Search for an address on Department of Transport and Planning’s property search.

What are the changes?

The Townhouse and Low-Rise Code introduces a new way to assess applications.

The new rules include all the standards from Clause 55. If a proposal meets a standard, it automatically meets the related objective. This means that authorities (like the Council or a Tribunal) cannot consider the decision guidelines for that standard.

The code also introduces "applicable" standards. If ALL "applicable" standards are met, objectors have no third-party appeal rights, even if other standards are not fully met.

The “applicable” 13 standards” relate to neighbourhood character and amenity:

  • 55.02 – Neighbourhood Character including:
    • 55.02-1 - Street setback
    • 55.02-2 - Building height
    • 55.02-3 - Side and rear setbacks
    • 55.02-4 - Walls on boundaries
    • 55.02-5 - Site coverage
    • 55.02-6 - Access
    • 55.02-7 - Tree canopy
    • 55.02-8 - Front fences
  • 55.04-1 - Daylight to existing windows
  • 55.04-2 - Existing north-facing windows
  • 55.04-3 - Overshadowing secluded open space
  • 55.04-4 - Overlooking
  • 55.05-2 - Overshadowing domestic solar energy systems

Where proposals comply with all the “applicable” standards of the Code (Clause 55 only), objectors are exempted from third party appeal rights irrespective of whether they comply with all the other remaining standards.

Information for neighbours/objectors

Applications will still be advertised, and objections can still be lodged. However, if an objection is about a standard that meets the code, the Council cannot request plan changes to address the concern.

If all "applicable" standards are met, objectors cannot apply for a review to VCAT.

If a proposed residential development also needs a permit under another planning scheme provision, like a Design and Development, Environmental, or Heritage Overlay, the objector appeal rights for that provision will still apply.

Applications for apartment buildings of four or more storeys are assessed under different provisions, and objector appeal rights remain.

Information for applicants

The new provisions codify all the standards contained within Clause 55 of the Manningham Planning Scheme. This means that where a proposal meets a standard, the corresponding objective is deemed to be met.

Applicants should familiarise themselves with the full suite of changes to Clause 55 of the Scheme. More details can be found on the Department of Transport and Planning’s website, as well as within the Manningham Planning Scheme.

Security Cameras

Closed-circuit television (CCTV) systems are located in and surrounding Council facilities. Manningham Council does not own or operate standalone CCTV systems in public open spaces.

CCTV systems are primarily for the protection of assets, risk management and public or staff safety. They form part of a suite of crime prevention strategies used to address specific local issues.

We are responsible for providing, installing and maintain the CCTV systems.

Privacy and Data Protection

CCTV footage collected will be treated in full compliance with the Privacy & Data Protection Act 2014.

Access to CCTV systems and data is restricted. Recorded data will be recorded over unless extracted and stored in an authorise alternate location. The length of time recorded data will be stored for will depend on the use of a camera or group of cameras. Typically recorded data will be stored for approximately 30 days.

Accessing CCTV footage

Manningham Council does not generally publish or disclose the footage obtained through the use of CCTV systems without the consent of the individuals shown in the footage.

Requests to view CCTV footage must be made under the Freedom of Information Act 1982. For more information visit Request Freedom of Information.

We cannot provide footage for traffic offences, unless made via a law enforcement agency.

Requesting a CCTV System

Visible CCTV cameras may enhance the perception of safety within the community. CCTV systems may form part of a suite of crime prevention strategies used to address specific local issues. They should only be applied where other Crime Prevention Through Environmental Design (CPTED) principles have been considered or implemented.

To initiate the planning process for the implementation or modification of a CCTV system, a written request is to be made outlining the issue(s) trying to be addressed.

Written requests can be sent to manningham@manningham@vic.gov.au or PO Box 1, Doncaster Victoria 3108.

Body Worn Cameras

We’ve introduced Body Worn Cameras (BWCs) for our Local Laws, Planning Compliance and Environmental Health Officers.

The BWCs will be clearly visible and attached to the officers’ uniforms during their duties. They aim to promote public reassurance, modify behaviour, prevent harm and deter people from committing offences. This is an additional tool to help improve officer safety, community trust, accountability and transparency.

BWC recordings can also support professional development through training and review, as well as assist with investigations involving allegations made against Council officers.

When BWCs will be used

BWCs will be activated during interactions where officers are performing their normal duties. The cameras are used in situations that require professional judgement to ensure safety and transparency.

How to know when a camera is recording

The BWCs are in pre-record mode but will only record when necessary. A clear light indicator on the camera will signal when it is actively recording.

What happens to the data

All footage recorded by BWCs is stored in a secure electronic location with strict controls and restricted access to protect against unauthorised viewing, copying, alteration and disclosure. Data that is not required for further investigation or in accordance with statutory requirements will be deleted after 90 days from date of being filmed, however this may be altered to 30 or 60 days based on operational needs.

For evidential files used in enforcement/prosecution proceedings, data retention periods are as follows:

  • files related to court proceedings are retained for minimum seven years
  • files related to enforcement outside the courts (for example, by way of infringement or notices to comply) are retained for minimum three years.

Law enforcement requests for BWC footage will be dealt with pursuant to the provisions of the Crimes Act. Access will be approved where Council is satisfied that the use or disclosure is required or authorised by law.

Accessing BWC footage

The data collected from the use of BWCs is subject to the Freedom of Information Act 1982.  Any written requests for access to data collected within 30 days of the data being taken will be held pending the outcome of the Freedom of Information application.

For more information or to make request visit Request Freedom of Information.

We welcome the Victorian Government’s commitment to purchasing only Zero Emission Buses (ZEBs) for public transport from 1 July 2025.

The move to ZEB’s will significantly reduce emissions and pollutants, creating a healthier environment for our community.

It will also provide a smoother, quieter and cleaner travel experience, which we hope will encourage greater use of Manningham’s extensive bus network.
