Trees in urban and semi-rural landscapes provide many benefits that include:

  • improving air quality
  • reducing storm water runoff
  • harbouring wildlife
  • reducing stress levels.
  • combating climate change by reducing heat island effects.

Recognising the importance of trees, the Victorian Government has planning controls to preserve trees and vegetation on private and public land.

If there’s an overlay protection, it’s an offence to remove a tree without a permit or development consent.

 

What you should do before applying for a permit

The best way to find out is:

  • to visit Mapping Manningham or
  • contact us.

 

Overlays that affect tree removal

Below is an overview of each overlay and what we look for when assessing an application. You’ll also find information on what you should do before applying for a permit.

 

The Environmental Significance Overlay (ESO)

What is an Environmental Significance Overlay?

Environmental Significance Overlay (ESO) is a planning control and covers most of the eastern half of Manningham.

ESO areas are important and any development of land must be compatible with identified environmental values of the particular area.

Vegetation may be a significant part of the environment in some areas as a habitat or link for native fauna. It can also contribute to soil stability and water quality as well.

 

What we look for when assessing a permit

An ESO has many challenges and we look for a number things when assessing a permit that includes:

  • The impact of any proposed buildings, works and any associated vegetation loss on the natural environment.
  • Significance of the flora, fauna and the landscape values of the area.
  • The possible impact of vegetation loss on landscape values.
  • Fire management requirements.
  • The impact on animal movement and survival.

Where a development or vegetation removal doesn’t meet the objectives of the ESO, modifications to preserve existing vegetation is generally required.

 

The Significant Landscape Overlay (SLO) and Vegetation Protection Overlay (VPO)

What is the SLO and VPO?

The Manningham planning scheme has 7 schedules to the SLO and 3 schedules to the VPO. This could mean that the planning controls for a property covered by the SLO or VPO differs from another property affected by the SLO or VPO.

It’s a good idea to talk to us before commencing any construction works or vegetation removal due to the complexity of these planning controls. You should confirm the permit requirements with us.

 

What we look for when assessing a permit application in an SLO and VPO area

When assessing a permit application, we look for some of the following:

  • The impact of the proposed buildings, works and any associated vegetation loss on the natural environment.
  • The built form and the existing preferred neighbourhood character of the area.
  • The possible impact of building height, location, bulk and general appearance on the character of the area.
  • The impact of vegetation loss on the landscape character or significance of the area.

Where a development or vegetation removal doesn’t meet the objectives of the SLO or VPO, modifications to preserve existing vegetation is generally required.

 

The General Residential Zones (GRZ)

In most GRZ where land is less than 4000m2, you will not need a permit to remove a tree within the property.

Clause 54 or 55 of the Manningham planning scheme applies to any proposed development within a GRZ area. The landscape objectives of both clauses is retaining significant canopy trees as part of any site development.

If you have removed a significant canopy tree 12 months before making an application, we will generally require you to replace the tree. Also there will be minimum tree planting requirements of the schedules to the zone.

It’s a good idea to get advice from a qualified arborist before removing a tree before any future development of the site.

 

The Heritage Overlay

A heritage overlay protects and enhances places of natural or cultural significance, including historical gardens or trees. You will generally need a permit to remove vegetation under this overlay.

It’s a good idea to talk to us to about the permit requirements and this planning control.

 

A Section 173 Agreement

Section 173 agreements are from the Planning and Environment Act 1987 and covers some local properties protecting trees from removal.

This planning control is complex and you should talk to us about the permit requirements before removing any trees.

 

Are there any exemptions from the tree removal requirements?

Dangerous trees

If a tree is dangerous and poses an immediate risk of personal injury or to property, an exemption applies. The exemption only applies to the part of the vegetation posing an immediate risk

You should get an arborist to inspect the tree for their advice on its condition. Advice relating to future management should be in writing. You can forward this info to us for confirmation.

Tree removal and bushfires

Areas where there’s a significant risk of bushfire that’s likely to pose a threat to life and to property, such as an area affected by bushfire management overlay (BMO), you can under some circumstances remove vegetation.

Removal, destruction or lopping of one Victorian native tree on a property greater than 4000m2.

What you should do before removing a tree

Talk to a qualified arborist (minimum Australian qualification framework level 5) before removing trees. They’ll be able to provide advice and an aboricultural report.

Along with an arboricultural report, we may also require the following info with your application:

  • a site plan
  • an explanation of the steps you’ve taken to avoid or minimise the removal of native vegetation
  • a landscape plan including any proposed replanting.

 

You can help by planting a tree

Contribute to the improvement of our urban forest and ecological values of the area by planting a tree on your property. native trees are best suited to the local environment.

Most permits will include a condition to replant an appropriate number of replacement trees if there’s been an approval to remove protected trees. We base our calculations of replacement trees on the replacement planting table from the Port Phillip and Westernport native vegetation plan.

  • Eucalyptus goniocalyx (Long Leaved Box)
  • Eucalyptus polyanthemos (Red Box)
  • Eucalyptus macrorhyncha (Red Stringybark
  • Eucalyptus ovata (Swamp Gum)
  • Eucalyptus obliqua (Messmate Stringybark)
  • Eucalyptus viminalis (Manna Gum)
  • Eucalyptus rubida (Candlebark)
  • Eucalyptus radiata Narrow-leaf Peppermint)
  • Eucalyptus dives (Broad-leaf Peppermint)
  • Eucalyptus camaldulensis (River Red Gum)

1. Before you apply

  • When do you need a permit for property and development

    New to planning? Get a general understanding of what permits you will need before making any applications

    Get advice in writing about whether or not your proposed building, works or land use needs approval from us.

  • Request pre-application advice

    Get feedback on your draft proposals, concepts or plans, before you submit a formal planning permit application.

2. Apply for the permit

5. We notify you of our decision once permit issued

  • Review of a planning decision at VCAT

    Only the Victorian Civil and Administrative Tribunal (VCAT) can review an application. After we have made a planning permit decision, we cannot undertake an internal review.

  • Pay or transfer landscape bond

    Landscape bonds are a condition of a planning permit. We ask for payment of bonds to ensure landscaping works are properly completed.

  • Get an extension of time for your planning permit

    If you need more time for development or commencement of land use, you will need to ask for an extension to the planning permit.

  • Request a section 173 agreement

    An Agreement under Section 173 of the Planning and Environment Act (or Section 173 Agreement) is a legal agreement between us and the owners of a property that is registered on a property title.

  • Amend a Planning Permit

    If you would like to to amend approved plans or conditions of a Planning Permit, you can find out more information and submit your application here.

  • Submit a construction management plan

    If you are developing land in Manningham, you may need to submit a Construction Management Plan (CMP) as required by a condition of your planning permit.

6. Once your development is completed

  • Apply for a landscape bond refund

    If your Planning Permit required payment of a landscape bond, you will need to apply for a refund once your development is completed.

Follow these easy steps to change your planning application details:

  1. Search for your planning application on the planning applications portal.
  2. Select change applicant details or withdraw your application.

Wurundjeri Elders will share stories around the cultural practice behind the recent tree scarring and shield projects, funded by Manningham Council, and lead art making activities and the planting of native grasses in Yaluk Langa.

Most of Manningham’s eastern half (more than 4,000ha, largely east of the Mullum Mullum Creek) is defined as a ‘green wedge’ area to protect natural and rural values.

 

Protecting the Green Wedge

Safeguarding the Green Wedge is vital for maintaining ecological balance, enhancing our quality of life, and promoting sustainable development. 

We are committed to protecting the Green Wedge, as expressed through several policies and protections in our planning scheme.

We have adopted the Green Wedge Infrastructure Design Guide, which aims to ensure sympathetic engineering works in this environmentally sensitive area.

Coronavirus (COVID-19)

Members of the public can attend Council meetings in person. We have reviewed our Council meeting practices to ensure we provide a safe environment for Councillors, staff and the community at meetings.  Council meetings will continue to be live streamed and we encourage you to follow the meeting on our Facebook page (even if you don’t have a Facebook account) or website. The live stream is not interactive. Any comments or private messages directed to us while the stream is live will not be presented to Council or have a bearing on the conduct of the meeting.

Other temporary changes to our Council meetings:

Public Question Time – At this time, anyone wanting to ask a question of Council should submit their question via email by 5.00pm on the Monday before the meeting. As you cannot be present in the chamber, your question will be read out at the meeting by the CEO. For more information visit the Council Meeting Procedures page.

Did you know that Manningham is one of the leafiest areas of metropolitan Melbourne with more than 656 hectares of Council-managed parks and reserves?

With more than 60km of shared trails, 300 individual parks and reserves, 165 play spaces, numerous picnic areas and walking paths to manage, our Parks Improvement Program sets out a plan for the future upgrades of all our parks over the next 20 years.

We are guided by our Open Space Strategy, the Eastern Region Sport, Recreation and Trail Strategy, specific park masterplans, community requests and planned facility renewal programs.

Our Parks Improvement Program identifies opportunities for improvements and ensures our parks and reserves are well maintained and upgraded as our population grows.

 

What is the Parks Improvement Program?

The Parks Improvement Programs sets out a plan for the future renewal and upgrade of all parks in Manningham over the next 20 years.

 

How was this program developed?

The Parks Improvement Program is based on recommendations from our Open Space Strategy, Eastern Region Sport, Recreation and Trails Strategy, specific masterplans for our parks, feedback and requests from our community and planned facility renewal programs.

 

What are the objectives of this plan?

This program will ensure our parks and reserves remain relevant and accessible to everyone into the future. It will make sure that facilities are in good condition and adapt to changing needs.

 

How is the schedule of renewal and upgrade determined?

For most park facilities like playspaces, furniture, paths and garden beds they need to be renewed every 20-25 years to ensure they are in a good and safe condition. Other factors are the level of use, i.e. Regional parks and playspaces get much higher use and wear out more quickly; the population growth in that neighbourhood; and demand for new facilities like fitness equipment, lighting and trails.

 

Does the program factor in new parks in the future?

Yes a number of new parks or expansion of existing ones has been determined in the Open Space Strategy to cater for gaps in provision, links to other parks or where there is higher density living occurring. These sites will gradually be acquired and developed as they become available.

Current park and playspace upgrades

Manna Gum playspace upgrade

Share your feedback and ideas for our Manna Gum playspace upgrade.  The proposed improvements will include upgrade and replacement of play equipment, more nature play opportunities, improvements to the access path, new tree and garden bed planting.

Burgundy Reserve upgrade

We are upgrading the facilities at Burgundy Reserve. The upgrade will include improved facilities for informal dog off lead activities as well as a new public toilet, an upgraded playspace, and a shelter.

We are upgrading the facilities at Warrandyte Reserve northern oval. The upgrade will include improvements to the path network, a new shelter at the northern oval, a new drinking fountain, and improved fencing and drainage.

We're upgrading the playground at Wombat Bend. The proposed upgrade will include minor enhancement of some play items and existing picnic facilities, as well as replacement of some play equipment that is no longer fit for purpose.

As part of 16 Days of Activism Against Gender-Based Violence,  we are are hosting this FREE workshop for you to learn the techniques required to communicate for social causes near and dear to your heart.

Join Nazanin and Attiane from Feminista Melbourne for an amazing poster making workshop. 

No minimum skill level is required. If you can use scissors and glue stick, you can make a collage.

Suitable for

This workshop is suitable for ages 16 years and up. For participants under 18 years of age, we require parental consent to attend this event. We will reach out to confirm prior to the event.

Workshop cancellation

Due to illness, unforeseen circumstances or where a suitable substitute is not available and a workshop has to be cancelled, you will be contacted via email and by SMS 30 minutes prior to the class starting. In these situations, either a class refund will be processed, or the event will be rescheduled.

Parking

Parking is available at Manningham Council MC2 building. There are two ways you can access the building – through the Doncaster library entrance on ground level or via the elevators from the MC2 underground car park.

The library entrance may be closed after hours. In which case, please enter via the underground Carpark at MC2 and take elevator to Level 2, exit right, turn left along walkway to the art studios.

Please note: Carpark entry gate automatically closes at 8pm but has a sensor for exiting as you leave at the conclusion of your class.

Join us for the Healthy, Happy & Wise: Healthy Ageing Forum, an informative event designed to support older adults in ageing well.

Featuring expert speakers from organisations such as Eastern Community Legal Centre, Bendigo Bank, and Elder Rights Advocacy, the forum will cover key topics including financial literacy, retirement planning, elder rights, housing, and active living.

The expert panel will be addressing key topics relating to healthy ageing, and what it means to be Healthy, Happy and Wise. 
Participants will be able to explore resource stalls, and enjoy complimentary morning tea.

Held in recognition of World Elder Abuse Awareness Day (WEAAD) 2025, this event highlights the importance of elder rights, ageism prevention, and a safe, respectful community for all.
