When do I need to apply for a permit?

It is best to apply for a permit to keep an additional animal before you purchase or acquire the animal. Ensure you know the details of the animal and include these on the application.

All applications are reviewed and assessed on a case-by-case basis.


What is the cost?

Each permit application is $150.00 This is a non-refundable application fee.

 

Your responsibility and the law

The Domestic Animals Act 1994 places clear responsibilities on the owners of dogs and cats to ensure they are registered from three months of age and that they are securely confined to the owner’s property.

The Act also places a clear responsibility on the owner of an animal to ensure it does not create a nuisance to people or cause any harm. If you already own the animal, please ensure it is registered.  

How to apply

  1. Check to see how many animals you are allowed to keep on your property

    View the table below to find out the type and number that can be kept under local laws.

  2. Register your pet

    If you already own the animal and it is a dog or cat, make sure it is registered.

  3. Complete the application to keep additional animals

How many animals can be kept on a property?

 

The number of animals that can be kept on residential land without a permit has been revised and is now dependent on the size of the property and the zoning of the property. See new limits in the table below.

 

Check the below table to find out which animals you can keep on your property in Manningham. If the number is zero (0) you can not keep that animal. 

All animals kept on residential land must be owned by the owner or occupier of that property.

*All cats and dogs over the age of three months must be microchipped and registered with the Council.

 

When do I need a permit?

A permit is required for keeping additional animals on residential land.

Residential land includes:

  • Land zoned as Low Density.
  • Mixed Use.
  • Residential Growth.
  • General Residential.
  • Neighbourhood Residential.

If you do not know the size or zoning of your land, visit the Department of Transport and Planning website or contact us.

 

Domestic birds

A permit under the Community Local Law is no longer required to keep domestic birds on residential land.  However, all birds must be kept in an appropriate manner that does not cause nuisance or offence and are confined to property.

 

Animal housing

Animal housing must be adequate and appropriate based on the type and number of animals kept, kept in a clean condition and placed in an area which does not create a nuisance.

 

Animal containment 

An owner or person in charge of an animal other than a dog or cat must ensure that the land used for keeping an animal or any structure for housing is:

  • clean
  • does not cause a nuisance to any other person
  • is adequately fenced
  • is kept free from rubbish or vegetation that could attract or harbour rats or vermin.

All animal food for consumption must be kept or stored in a vermin and fly proof container.

All animal waste must be removed so as not to be offensive or a nuisance to any other person.

 

Existing permits

Where a pet owner has an existing permit issued under the previous Local Law, this permit will remain in place on the land until the existing permit expires. Existing permits will be reviewed if there are concerns relating to nuisance.

What happens next?

Allow 10 business days for us to review your application and make contact with you.

An invoice will be issued to pay the permit application fee. No permit will be issued unless fee is paid.

When assessing applications, Council will consider:

  • feedback from neighbouring properties. 
  • the impact the animals will have on amenity.
  • the welfare of the animals.
  • other Planning Scheme requirements.
  • prior history associated with animal keeping.

An inspection of the land will occur to ensure the site is appropriate for the number of animals.

You will be advised if a permit is to be issued.

The permit will contain conditions which you will need to comply with.

We use septic tanks for properties where sewerage is not available to dispose of domestic wastewater from toilets, bathrooms, laundries and kitchens.

 

What types of septic tanks need a permit?

All septic tank installations need approval. The type of approval depends how much sewerage your septic tank disposes per day.

For septic tanks designed to:

  • dispose less than 5000L > apply for permit with us

  • dispose of more than 5000L > apply for licence with Environmental Protection Agency (EPA).

 

When do you need to get the permit?

You must get a permit before any works to install or alter a septic tank system.

How to prepare your application

Before applying, gather your proposed plans to include:

  1. Dimensions of all boundaries of the site

  2. Location and dimensions of all
    1. buildings or proposed buildings
    2. streams
    3. water tanks
    4. tennis courts
    5. swimming pool excavations
    6. driveways
    7. stormwater drains
    8. water pipes
    9. existing septic tank systems.

Home Harvest Manningham is a monthly home gardening seminar series that will teach you how to grow your own delicious fresh food at home.

Karen Sutherland has a lifelong passion for growing her own food. In this seminar Karen will share with you her expertise in incorporating a bush tucker garden at your place.

This session will cover:

  • the best bush food plants for gardens in Manningham
  • which plants to pot vs those to plant in the ground
  • basic growing information
  • the basics of harvesting bush 'tucker'
  • simple uses for both fresh and dried plants.

Start your passion for native edibles such as lemon and cinnamon myrtle, native thyme and sage, peppers, mints, fruits and berries.

Food swap from 6.45pm, session starts at 7.00pm.

Registration is recommended but not required.

Presented by the Astronomical Society of Victoria (ASV) and Manningham Council,

Join the ASV with a stargazing evening at Westerfolds Park, Templestowe. ASV astronomers will be on hand with telescopes and demonstrators.

Bring a torch covered with red cellophane (to keep your night vision), mosquito repellent and warm clothes. Telescopes will be set up on the grassy field near the Parks Victoria Office. Expect evening dew and a cold evening. Children will especially appreciate warm footwear and snacks!

Please reverse your car into the parking space to reduce headlight shine on exit.

This event may be cancelled due to cloud cover (more than 25 percent cover) or in the event of a total fire ban or bad weather. Please provide a relevant contact mobile phone number or email for an automated update on any event changes.

Participant information:

  • Children must be supervised by a parent or guardian at all times. Please arrive 10 minutes prior to start time.

Local Government Act 2020

Local Government in Victoria is administered under the Local Government Act 2020, which provides a framework for the establishment and operation of councils.

The Act is the main legislative instrument for Victoria's seventy-nine councils.

Part 1A of the Local Government Act contains the Local Government Charter, which describes the purpose, objectives and functions of council.

In addition to these matters, the Local Government Act also includes provisions for:

  • entitlements for residents and ratepayers to vote in council elections
  • the conduct of local council elections, nominations and vote counting
  • independent Electoral Representation Reviews by an electoral commission
  • council governance requirements, including codes of conduct and disclosure of conflicts of interest
  • council decision making, including records of meetings, confidentiality and limits on decisions during election periods
  • levying and payment of council rates and charges
  • preparation of Council Plans, budgets and annual reports
  • council's powers to make and enforce local laws.

 

Community Local Law

Manningham’s Community Local Law 2023 is a local law made under Part 3 of the Local Government Act 2020 and section 42 of the Domestic Animals Act 1994.

This Local Law is made in recognition of Manningham’s Generation 2030 Community Plan and the Council Plan, which, as Council’s overarching strategic documents, provide a long-term shared vision for Manningham and the community by guiding the development of policy and strategies.

Human Rights Charter

The Victorian Charter of Human Rights and Responsibilities Act 2006 is a law that protects the human rights of all people in Victoria.

The Charter requires all public authorities and their employees to act compatibly with human rights in the delivery of services and when making decisions.

Manningham City Council recognises and respects that everyone has the same human rights entitlement to allow them to participate in, and contribute to, society and our community. We recognise that all persons have equal rights in the provision of, and access to, Council services and facilities. We also recognise that, at times, such rights may be limited, insofar as to strike a balance between individual rights and the protection of public interest.

The Charter complements other laws such the Equal Opportunity legislation and protects rights such as freedom of speech, freedom from forced work and freedom from degrading treatment which previously had no legal protection. The Charter sets out a list of twenty rights that assist all people to live with freedom, respect, equality and dignity.

Fraud and Corruption Control

Council is the custodian of significant public funds and assets therefore it is important that the community has assurance that these are adequately protected. 

In December 2022, Council approved the Manningham Council Fraud and Corruption Policy.

The Policy sets out specific guidelines and responsibilities regarding appropriate actions that must be followed for the investigation of fraud and corruption and other similar irregularities.

The Policy should be read together with the Manningham Risk Management Strategy and relevant legislation.

Public Interest Disclosures Procedures


The Public Interest Disclosures Act 2012 (the Act) facilitates the making of public interest disclosures about improper conduct within the public sector without fear of reprisal. The Act aims to ensure openness and accountability by encouraging people to make disclosures and protecting them when they do.

Manningham is committed to the aims and objectives of the Act and encourages the making of disclosures about improper conduct. Council will not tolerate improper conduct by the organisation, its workers or Councillors nor the taking of reprisals against anyone who discloses such conduct.

What is a public interest disclosure?

Public Interest Disclosures (PID) are reports about:

  • Improper conduct of public bodies or public officers (such as corrupt conduct).
  • Detrimental action that a public body or public officer has taken against a person in reprisal for them (or another person) having made a PID or cooperating with the investigation of a PID.

A person making a disclosure must believe, on reasonable grounds, that the Council, worker or Councillor has engaged in, or proposes to engage in, improper conduct.

How do I make a public interest disclosure?

A PID may only be made by a natural person or a group of people making a joint disclosure. A PID cannot be made by a company or organisation.
We can only address disclosures that relate to Manningham City Council and its workers. A person making a disclosure can do so by contacting Council or the Independent Broad-based Anti-Corruption Commission (IBAC).

Council recommends that a written disclosure is sealed in an envelope and clearly marked:

  • “Private and Confidential – Attention Mr Andrew McMaster, Chief Legal and Governance Officer”.
  • Or by email to Andrew McMaster: andrew.mcmaster@manningham.vic.gov.au.

If your disclosure is about a Councillor, your disclosure must be made to the IBAC or the Victorian Ombudsman.

How will Manningham protect me if I make a disclosure?

Manningham will take all reasonable steps to protect a person who makes a public interest disclosure. All correspondence, phone calls and emails from a discloser will be referred to the Public Interest Disclosure Coordinator.

The Public Interest Disclosure Coordinator will take all necessary steps to ensure that the identity of the discloser and the person who is the subject of the disclosure are kept confidential. Where appropriate welfare support will also be provided.

Anyone considering making a disclosure is encouraged to read Manningham’s Public Interest Disclosure Procedures on this page. The procedures will guide you through the process and help you understand how to make a disclosure and activate the protections available under the Act.

Alternatives to making a public interest disclosure

The Public Interest Disclosures Procedures are designed to complement normal methods of submitting a complaint to Council and existing communication channels between workers and line managers. If your complaint does not meet the threshold of a public interest disclosure, it will be referred through to the appropriate person for action.

Who can book a bundled branches collection?

If you have a residential bin collection service with us, you can choose to have up to two bundled branches or hard rubbish collections (or a combination of each) per calendar year. You can book:

  • A standard collection (2m3)
    For a pile of 2m x 1m x 1m
  • Or use both collections at once (4m3)
    For a pile of 4m x 1m x 1m

What items can and cannot be collected?

The bundled branches collections are dedicated for branches that cannot fit into your FOGO bin.

Yes, we collect:

  • Pruning materials and tree branches that are less than 75mm in diameter and 1.5m in length (must be securely tied with cotton string or twine in bundles, up to 300mm in diameter)
  • Single tree limbs/logs that are between 75mm and 200mm in diameter and 1.5m in length (must be free of branches and leaves and neatly stacked)
  • Tree roots that can be lifted by one person

No, we don't collect:

  • Untied bundled branches or branches exceeding 1.5 metres in length or 75mm in diameter
  • Tree roots that cannot be lifted by one person
  • Large logs, stumps or timber
  • Soil, earth, bricks, rubble, building materials or fencing
  • Leaves, grass, weeds, ivy, rose bushes, thorny plants, bamboo and palm trees or branches
  • Bundles tied with wire, plastic string or ties, stocking or other non-organic material
  • Garden waste in plastic bags, polystyrene boxes or wheelie bins
  • Food waste

How to prepare items for collection

  1. Check what items can and cannot be collected

    View items (listed above)

  2. Make a booking before your place items on nature strip

    Book before 5.00pm each Wednesday to have items collected the following week (except during the Christmas and New Year period).

  3. After your booking is confirmed, place your items on the nature strip.

    Place your items no earlier than the Sunday before the week of your collection.
