Footpath trading is an essential part of our retail experience and can include:

  • outdoor dining with tables and chairs
  • placement of goods for sale and display
  • display of A-frame advertising boards.

Although we encourage footpath trading in Manningham, there’s a few things that you need to know.
 

When do you need a permit to use the footpath?

 

You need a permit if the footpath is on Council land and you want to place items, such as:

  • moveable advertising signs
  • goods
  • street furniture (such as: tables, chairs, barriers, umbrellas, planter boxes, heaters).

 

What is "Council land"?

Council land is any land, including reserves or roads which are owned, vested in, managed by or under the control of Council and includes any building or structure on that land, within a reserve or on a road.

 

Keeping pedestrians safe

We have a duty to make sure pedestrians are safe. That’s why traders need to maintain minimum distance of clear footpath from the property line.

You can’t place objects such as moveable advertising signs, goods and street furniture against the property line or shop front.

These rules allow people using the footpath to walk through the area safely.

Report graffiti or vandalism

Vandalism, graffiti and bill posting negatively impact our neighbourhoods and individual properties. Rules exist which prohibit, regulate and control the adverse nature of these activities.

If graffiti or street art is placed on a building or infrastructure without permission of the owner, it's considered illegal and may be removed.

Check what type of graffiti or vandalism you can report and where you can report it.

What to report

Graffiti on council owned property

  • We will remove graffiti from council owned properties, buildings and facilities.
  • We will remove graffiti from council owned items such as park furniture, council signs and rubbish bins.

Graffiti on private property or non-council owned property

  • For all other private property, it is the owner's responsibility to remove the graffiti.

 

We will continue to maintain a zero–tolerance approach in managing graffiti with our graffiti removal maintenance program.

The maintenance program identifies and removes graffiti on Council assets.

Vandalism

  • You can report vandalism to Victoria Police on 131 444.

How to report an issue

  1. Prepare the following information before you report:
    • The location of the issue.
    • The date and time of when the issue occurred.
    • Summary of what has been damaged
    • Photo of the graffiti or vandalism (if possible)
    • Historic details leading up to you reporting this issue.
    • Your contact details if you'd like an update. Or, you can remain anonymous.
    • Other details that will assist us with your specific issue.
  2. Report the issue to us

    You can make a report online, in person or over the phone.

What happens after you have reported an issue?

  • We will attend the location and determine whether we can assist.
  • We may follow up with you to get some further information.
  • We will take the appropriate action or find out who can.

Under the Manningham Planning Scheme there are a range of requirements relating to real estate advertising and promotion of properties for sale.

 

For Sale and For Lease signs

When a property is for sale or for lease, one sign can be placed on the land or property being offered for sale or lease without the need for a planning permit.

Conditions for displaying signs (must not):

  • not have an advertisement area exceeding ten (10) square metres
  • not be animated, illuminated (internally or externally)
  • not cause a hazard or obstruction

 

Conditions for displaying signs (must):

  • placed as close to a property boundary or entrance to the property as is practicable
  • displayed on the same side of the road as the subject property frontage
  • removed from display within seven (7) days of the property no longer being offered for sale or lease

 

The exemption from requiring a planning permit is included in the Manningham Planning Scheme as clause 52.05-4 and is only valid during the period that the property is available for sale or lease.

If the sign cannot be placed on the subject property and is required to be placed on Council land, a Local Laws permit will be required. See below for more information.

 

Pointer boards 

Real estate pointer boards placed on private property require a planning permit, unless they are placed on the property being offered for sale or lease and are the only sign being displayed relating to the sale or lease of that property. 

In all other circumstances, pointer boards are considered a promotion sign and require a planning permit from Council to be displayed on private land. The display of pointer boards on Council land is prohibited.

Under the Local Law, a permit can be issued to allow for the placement of pointer boards on Council land. See below for more information.

When Is A Permit Required?

Manningham’s Community Local Law

A person must not without a permit, write, draw, paint or mark, affix a poster, display a sign or advertisement on Council land, on a Council asset or in a public place.

  • Real estate sign: Is a sign placed at the front of a property being offered for sale, lease or auction which publicises the sale or letting of the property on which it is displayed.
  • Real estate pointer sign: Is a small sign located at the intersection of two or more roads, indicating the direction towards properties available for sale.

  1. Download and complete the Real Estate Sign and Pointer Board Application form.

  2. Submit a copy of your Public Liability Insurance.

    A copy of your public liability insurance must be submitted with the form.

    The certificate must be current and provide cover for the period of the permit: 1 July to 30 June.

    Cover must be to the value of or greater than $20 million.

  3. Pay the permit fee.

    A Permit is valid from the 1 July each year and expires on 30 June following year.

    2023/24 Fee: $667.10 (valid from 1 July to 30 June)

Where visible from a public space, properties with excessive rubbish or disused excavation materials may be classified as unsightly and the owner may be required to clean up their property.

How to report an issue

  1. Prepare the following information before you report:
    • The location of the issue.
    • The date and time of when the issue occurred.
    • Photo of property (if possible)
    • Historic details leading up to you reporting this issue.
    • Your contact details if you'd like an update. Or, you can remain anonymous.
    • Other details that will assist us with your specific issue.
  2. Report the issue to us

    You can make a report online, in person or over the phone.

What happens after you have reported an issue?

  • We will attend the location and determine whether we can assist.
  • We may follow up with you to get some further information.
  • We will take the appropriate action or find out who can.

If you are organising a public or private event in an outdoor Council-owned land such as a park, garden, reserve or street in Manningham, you may require approval.

You will need approval from us if you’re organising a public or private event in our:

  • parks
  • gardens
  • reserves
  • streets.

We will explain below which events will need approval.

 

Events that do not require our approval

You will not need approval if your event has:

  • 1-80 attendees
  • BYO catering that doesn’t require vehicle access into the park
  • no infrastructure such as marquees, stages, jumping castles
  • low noise impact
  • no change to normal traffic and parking conditions.

 

Events that require our approval

If you are hosting the following types of events, you will need our approval.

 

Low impact events

If your event has one or more of the following:

  • 81-500 attendees
  • 1-5 caterers or food vendors
  • limited temporary infrastructure such as less than 5 marquees, additional tables and chairs
  • low noise impact
  • low change to traffic and parking conditions.

Minimum notice we require is 6 weeks.

Medium impact events

If your event has one or more of the following:

  • 501–2500 attendees
  • 5-10 caterers or food vendors
  • moderate temporary infrastructure such as a stage, PA, less than 15 marquees, toilets
  • moderate noise impact
  • moderate change to traffic conditions, road closures and parking.

Minimum notice we require is 3 months.

High Impact Events

If your event has one or more of the following:

  • 2501 or more attendees
  • 15 or more caterers or food vendors
  • substantial temporary infrastructure such as multiple stages, PA, 15 or more marquees, toilets
  • high noise impact
  • substantial additional traffic, multiple road closures and changes to traffic and parking conditions.

Minimum notice we require is 6 months.

High risk activities

You will need our approval if your event includes:

  • alcohol
  • amusement rides such as jumping castles or inflatables
  • road closures
  • any pyrotechnics such as fireworks or firecrackers.

Events on private property

You will not need approval if your event is on:

  • private property
  • schools
  • federal or state owned land.

If your event will impact surrounding areas that includes traffic, noise and waste, please speak to us on how to best manage these impacts.

How to apply for event approval

If you are holding an event and need our approval, please follow the application process.

  1. Submit a request to hold an event on council land form.

  2. We’ll let you know when we’ve received your application and if the date and location you’ve requested is available. We’ll also send you a list of requirements you must submit as part of the approval process.

  3. If your event impacts traffic conditions or parking at a Council owned venue, you will need a traffic management plan. This needs to be approved before event approval can be supplied.

  4. Once your event application has been received, you will be asked to provide supporting documentation, such as:

    • Certificate of Public Liability Insurance
    • Event Plan
    • Risk Management Plan 
  5. When all documentation has been received and approved, your event approval will be sent.

Paying bonds

You might need to pay a bond if your event is on Manningham land. The amount for a bond ranges from $50 to $5,000. The bond amount will depend on the size and nature of the event.

The purpose of a bond is to cover costs if there’s damage to any:

  • infrastructure, including trees
  • bollards
  • pathways.

Bonds will also cover any costs to replace gate keys or charges to clean leftover waste.

You’ll receive a full refund after a post site inspection if we determine there’s no requirement for reinstatement.

Demonstrations, rallies and public assemblies

If you are planning on organising a demonstration, rally, or public assembly on Manningham Council land let us know so that we can communicate to nearby stakeholders, residents or businesses that may be impacted.

Prior to reaching out to us you must contact Victoria Police for advice and to discuss potential police resourcing.
