You may need to apply for a planning permit and application before you start a new development or commence a new land use. A planning permit gives you permission to use and/or develop land in a certain way when there’s a requirement for a permit. After granting a planning permit, you may also need other approvals from building, health, local laws and engineering.

We can fast track some applications. Check to see if your application is eligible for the VicSmart process.

 

Talk to us before you apply for a planning permit

You can organise a pre-application meeting. This gives planning officers the chance to provide feedback before you submit a formal planning permit application in relation to:

  • draft proposals
  • concepts
  • plans.

You can organise a face-to-face meeting or receive a written response. This is an optional service and there will be a pre-application fee.

How to submit your application

  1. Obtain a recently copy of Certificate of Title from Landata that’s no more than 3 months old, including a full copy of any restrictive covenants or section 173 agreements.

  2. Obtain a Plan of Survey from a licensed land surveyor.

  3. A covering letter explaining your proposal and any accompanying reports. This can include a planning report clearly identifying details of the proposed business such as operating hours and number of staff.

  4. Provide a copy of any other detailed reports such as arborist or traffic reports and a copy of your paid Metropolitan Planning Levy (If required).

  5. Electronic site and elevation plans prepared by a suitably qualified architect or draftsman drawn to scale. It should also clearly depict

    • any existing and new buildings
    • finished floor levels
    • site levels
    • setbacks from all boundaries
    • wall and overall building heights taken from natural ground level at the building line as well at the boundary line
    • existing vegetation to remove or retain (including tree protection zones and canopy drip lines)
    • car parking and accessway design
    • proposed earthworks/areas of cut and fill along with retaining wall and fence details.
    • In addition there may also be other reports/information requirements as detailed by the Manningham Planning Scheme.

We issue tradesperson permits for building works within an existing residential development.

The number of permits available is limited to a maximum of four permits at any one time.

A permit can only be issued for a period of up to 12 weeks and generally will not be renewed.

The tradesperson's vehicle permit will enable a vehicle to park in a residential parking zone between Monday and Friday 7.00am to 5.00pm (each day). Outside of these hours any existing parking controls will apply.

Permits are only valid when being used to complete on-site works at the property to which they are issued. They are not for private/personal use at any time.

Application can be made by: 

  • A resident of the property.
  • The owner of the property (regardless of whether or not they are living at the property)
  • The tradesperson who will be doing the works.

Where construction works are to take longer than 12 weeks, an application for the installation of a Work Zone should be applied for.

What is a VicSmart application?

VicSmart is a fast track process for straightforward planning applications compared to the standard planning permit process.

These applications are not advertised to nearby properties and generally decided within 10 business days. Some types of applications have a reduced fee.

 

What types of applications qualify as VicSmart?

There are a few things to consider to see if your application can follow the VicSmart process. 

1. What planning controls affect your property. To view planning controls, you can: 

  • Generate a property report
  • View the Manningham Planning Scheme

2. What type of application you are applying for. The following may be assessable as a VicSmart application:

  • Realigning the common boundary between two lots.
  • Some classes of subdivision in accordance with an approved development.
  • Construction of a front fence in a residential zone.
  • Alterations and additions to a single dwelling.
  • Buildings and works for carports, garages, pergolas, verandahs, decks, sheds or similar structures.
  • Removal, destruction or lopping of one (1) tree.
  • Some buildings and works, and erection and display of signage in a commercial area or activity centre.
  • Reduction or waiver of parking space requirements (by a maximum of 10 parking spaces).

Not all residents are entitled to Parking Permits.

In 2019 Council reviewed its parking permit policy. This policy clarifies who can obtain a permit to park within a residential parking zone.

Residential Parking Permits are valid for 12 months from the date of issue. 

Residential parking permits will only be issued where the property is the applicant’s primary place of residence and not property owners (landlords) who lease their property out.

Residential Parking Permits will not be issued to properties not used for residential purposes (i.e. used solely for commercial or another non-residential purposes).

Permits are not transferrable between residents of different addresses.

Some Council managed carparks have limited trader parking available.

We will only issue a trading parking permit to either:

  • an individual business
  • a recognised traders association.

Permits will be issued for areas where trader parking restrictions apply and that we monitor.

We may not issue a permit to businesses that have access to off street parking for their business.

If you require a replacement Trader Permit for a lost or stolen permit you must provide a Statutory Declaration and pay a fee.

We issue carer permits to a person or an organisation that provides care service.

A carer permit will exempt a vehicle:

  • from time limited parking restrictions greater than 15 minutes
  • within residential permit zones when delivering a care service.

 

Carer Permits are issued to an individual employed in the delivery of a care service or to an organisation that provides a care service between 6 and 12 months based on need of the recipient of the care service.

What is a Section 50 Amendment?

A Section 50 amendment lets you change your planning application before it’s advertised to the public.

You can use it to:

  • Update your plans or documents.
  • Change the proposed use of the land.
  • Correct or change the property address.

This type of amendment is only available before public notice is given and before a decision is made.

 

Who can apply for a Section 50 amendment?

You, your agent or the current owner can make an amendment if:

  • There’s a planning permit application in progress.
  • The permit application hasn’t been through public notification.
  • We haven’t made a decision on the application.

 

When can you apply?

You can apply for a Section 50 amendment before public notification if:

  • You're responding to feedback from a request for information (RFI) letter.
  • You want to make your own changes to the application.
  • You need to update the permit preamble (e.g. changing from a two-storey to a three-storey dwelling).
  • You want to include additional land in the application (e.g. expanding the development to an adjoining property).

 

How to prepare your application

Search for your planning application on the planning applications portal and select "S50 Amendment".

We will then use an RFI and ask for amended plans and documents. We usually receive section 50 forms and amendments all at once.

What happens next?

Once we have received your application, a planner will make an assessment on whether we will require an RFI or not.

We will send a letter if there is an RFI requirement.

If there is no RFI requirement, the planner will determine whether there is a need for advertising.

Schramms Cottage

The cottage provides a picture of life in the pioneering days of the late 1800s.

Schramms Cottage dates from approximately 1875. It is an asymmetrical cottage, built of local sandstone with a hip slate roof. It was built for Max von Schramm, a German immigrant, for use as a house and a Lutheran school.

In 1876 von Schramm was appointed the first Lutheran Pastor in Doncaster and he continued to teach at this school until 1884.

The cottage was originally located in Doncaster Road, near the present Council offices and was moved to its current site following a decision to widen Doncaster Road. The process of dismantling and re-erecting the building took place between 1971 and 1975, using largely voluntary labour. Schramms Cottage was opened as a historical centre on 14 February 1976.

Any person who believes they will be affected by a planning application can lodge an objection.

 

Things to do before lodging an objection

Make sure you look at the advertised plans and supporting documents before lodging an objection. You can find them on the Planning applications portal.

 

When should you lodge an objection?

Advertising of an application runs for a minimum of 14 days. You should lodge an objection during the advertising period using the Planning Applications Portal.

This allows for consideration of your concerns before there is a decision on the application.

 

What information must you contain in your objection?

To submit an objection, it must include the following information:

  • be in writing with your full name, address, phone number and email
  • state the grounds for your objection and;
  • describe how you will be affected by the granting of a permit.

 

How to lodge an objection

A person can submit an objection to an application using the Planning Applications Portal.

You will receive an acknowledgement email of your objection.

 

Who can view an objection?

Your objection, including the personal information supplied, may be:

  • inspected in person at Manningham Council’s offices during Council business hours
  • published online via a private service for third parties to view by appointment only, where there is a written request to us
  • distributed to the permit applicant or their representatives where we have received a request 
  • distributed to parties involved in a VCAT proceeding relating to this permit application, when applicable.

In accordance with the requirements of the Planning and Environment Act 1987.

 

Will there be a consultation meeting?

Not all applications will need a consultation meeting. An officer will determine if one is necessary.

If we require a consultation meeting, its aim is bringing the parties to the application together. Our officers and where available, ward councillors, will also be in the meeting.

The objectives of a meeting is:

  • to give objectors a chance to clarify or emphasise key aspects of their objection
  • to give applicants a chance to clarify the objector’s concerns and respond where appropriate
  • to seek a mediated outcome on key issues, where possible.
     

Will there be a decision made on an application at the consultation meeting?

Consultation meetings are part of the decision making process, but there’ll be no decision made on the application on the night of the meeting.
 

What happens after a decision has been made?

Applications will be either approved or refused. Objectors will receive notification of the decision in writing.

If we approve a planning application, we may issue a Notice of Decision to grant a planning permit. This is not a planning permit. It is a notice that sets out the conditions we will apply to the permit if there’s no appeal lodged to the Victorian Civil and Administrative Tribunal (VCAT).

Under certain circumstances, we may proceed to immediately issue a Planning Permit even if objections are received. Some classes of application (for example - some applications on Council land, State Government Projects, and projects for non-Government schools) are specifically exempt from third party review rights.

Under the new Townhouse and Low-Rise Code in effect from March 2025, some applications for townhouses and residential buildings may be deemed to meet all relevant standards of the Code. Where this is the case,  there will be no objector appeal rights and we will issue a Permit, rather than a Notice of Decision. For more information on the Townhouse and Low-Rise Code, please refer to the Department of Transport and Planning's website.
 

Appealing a decision

If you receive a copy of a Notice of Decision to grant a planning permit, you will have 28 days to lodge an application for review to VCAT.

We will issue a planning permit after 28 days if there are no objector appeals lodged to VCAT.

What is a Secondary Consent and Section 72 amendment?

After receiving a permit and having your plans endorsed, you may decide to make changes to the endorsed plans.

You can make a secondary consent amendment if the changes are minor.

If the changes are more significant, you may require a Section 72 amendment.

A Section 72 application follows a similar to a new permit application - this means it may include public notification and the opportunity for people to submit objections.

 

Secondary Consent amendments

When should you use a secondary consent amendment? 

You can use a secondary consent amendment: 

  • after the issuing of a permit 

  • if the permit contains the condition, “The development as shown on the approved plans must not be altered without the written consent of the Responsible Authority.” 

  • if we’ve endorsed the plans under the permit 

  • if the permit hasn’t expired 

  • if the proposed changes are minor and meet the relevant secondary consent ‘tests’. 

 

What are the secondary consent ‘tests’? 

A secondary consent amendment is only for minor changes to plans after approvals. It does not require public notification. 

You will need to meet the following ‘tests’ to qualify for a secondary consent amendment: 

  • It doesn’t result in the transformation of the proposal. 

  • It doesn’t introduce something where we require additional approval or assessment under the planning scheme. 

  • It’s of no consequence having regard to the purpose of the assessment of planning controls after the granting of the original planning permit. 

  • It’s not contrary to the wording, conditions or both on the planning permit. 

You will need a section 72 amendment if you don’t meet the ‘tests’.

Examples of changes we will consider under secondary consent

Some of the following common changes we’ll consider under secondary consent includes the following: 

  • Internal floor plan reconfigurations that don’t impact the exterior appearance or windows of the building. 

  • Amendments to landscaping that don’t impact any permit conditions. 

  • Adding a small verandah or pergola. 

  • Adding a low-scale fence, depending on the planning controls. 

  • Changes to the colours or materials on external walls, features or both, to a building.

  • Select Secondary Consent amendment from the list of available actions for Planning Permit applicant 

Online lodgement of Secondary Consent Amendments may not be available for Permits issued before July 2017. If this option is not available, contact us or email PlanningApplications@manningham.vic.gov.au to obtain a manual application form.

How to pay

When a secondary consent amendment request is lodged: 

  • A Planning Officer will undertake a preliminary assessment to determine whether your changes are eligible to be considered through the secondary consent amendment process.  

  • Once a request is determined to be eligible, an invoice for payment by credit card, BPay or Post BillPay will be emailed to the applicant. 

  • Otherwise, you may receive advice requiring you to relodge your request as a Section 72 Amendment. 

This preliminary assessment process may take one to two weeks. 

Section 72 Amendments

 

What changes can you include in a section 72 amendment? 

Section 72 of the Planning and Environment Act 1987 provides the legislative framework for the amendment. 

A section 72 amendment to a permit can include: 

  • a change or addition to the land use that the permit approved 
  • a change to the property address to which the permit applies 
  • a change to the plans, other documents or both, endorsed under the permit 
  • a change to the wording of the permit such as the proposal description or conditions. 

The following changes must be a Section 72 and cannot be considered under Secondary Consent:

  • changes to the permit conditions 
  • changes to the permit description 
  • changes to windows that’s visible to neighbours 
  • noticeable building setback or height changes 
  • any changes impacting off-site amenity to adjoining properties. 

 

What you will need for a Section 72 amendment 

If you are applying for a section 72 amendment application, you will need: 

  • a recently searched full copy of Certificate of Title from Landata 
  • a cover letter detailing your proposed changes 
  • a summary in writing of the reasons why you’re requesting the amendments 
  • an electronic copy of your revised plans 
  • pay the application fee.

Why register your pool or spa?

New swimming pool and spa laws were introduced by the State Government in 2019 to enforce safety barrier standards and reduce the number of deaths by drowning among young children.

The new laws require your private pool or spa to:

  1. be registered with your local council
  2. provide proof that you're complying with existing safety barrier standards

You are responsible for ensuring your private pool or spa remains compliant at all times.

 

Which type of pools and spas need to be registered

Swimming pools and spas need to be registered. What is the definition of a swimming pool or spa?

Yes it needs to be registered if:

  • Relocatable pool or spa capable of containing a water level of 300mm (30cm) or above
  • Permanent pool or spa capable of containing a water level of 300mm (30cm) or above

When to register by?

Existing pools or spas must be registered by 01 November 2021.
New pools or spas must be registered within 30 days of completion.

Failure to register in time may result in fines or legal action.

 

How much does it cost

The registration cost depends on when your pool or spa was built. The fee includes:

  • Information search fee for pools and spas construction prior to 1 June 2020 (only for existing)

What happens next?

After you have registered your pool or spa, you'll need to:

  • Get your pool or spa certified by a registered inspector to provide you with a certificate of compliance

  • Continue to maintain your pool or spa barrier. You'll need to submit a new certificate of compliance to us every four years.
  • Let us know if your pool or spa is removed

The State Government has a zero tolerance approach to any owners not committed to ensuring adequate water safety for young children. Significant penalties apply if a matter is brought before the court.

What is a section 57a amendment?

A section 57a amendment is a request to make changes to an application.

  • It is used after giving notice of the application.
  • It must be submitted before a decision is made on the application.

 

When can you make a section 57a amendment application?

You can make an amendment application if:

  • there is a planning permit application in progress
  • the permit application has been through public notification
  • we have not made a decision on the application yet
  • you have paid the application fee.

You might use this if:

  • you have changed your mind about part of an application and want to make changes before the planning officer makes a final decision
  • You want to respond to feedback or objections

For applications that don’t require advertising, use a section 50 amendment instead.

 

Making Changes to Your Application

You can ask to change your application during the process. This might include:

  • Changing what the land will be used for (for example, from residential to commercial).
  • Updating the property address the application is about.
  • Changing your plans or documents (this could be drawings, reports, or both).

These changes are called amendments, and they help make sure your application reflects what you really want to do.

Our community panel came together for the first time on Saturday for the first of six and half day’s deliberation.

The Panel recruitment started with 8000 envelopes sent randomly to local households. Of those who accepted the invitation, a second random draw resulted in the final 40 people chosen. This second draw was ‘stratified,’ set up, so people chosen were representative of Manningham by age, gender, location, living situation and the language spoken at home.

This will be our most significant deliberative engagement to date, with the panel set to play a crucial role in shaping our major strategic plans. 

Here’s some feedback from two panel members after day one:

“I was surprised when I got the invite but said to myself, I have grandchildren and what better way to leave a legacy for them but to have a say into shaping Manningham.” 

“I am from an accounting background so especially interested to look at Council’s financial documents and exploring that side of the process.”     

You can also participate in the deliberative process by registering to be an observer. Observing the process means that you can form your own assessment of the merits of the deliberative approach.

When do plans need to be endorsed? 

You may need to submit updated plans for endorsement as a condition of a planning permit before a use or development can commence. This can include:

  • Amended development plans (commonly referred to as “Condition 1 Plans”, in reference to the requirements of condition 1 of a Planning Permit.)
  • Landscape Plans
  • Construction management plans
  • Other management plans for ongoing requirements once a development is complete (such as a bushfire management plan, waste management plan – refer to conditions of your planning permit for further advice)

Multi-unit developments may also need to submit updated on-site detention (stormwater management system) plans.

 

How much does it cost?

No fee is applicable for review of plans submitted for endorsement - unless changes have been made beyond the scope of Permit conditons and an amendment may be required. See below for more information.

 

How to lodge

  1. Search for your permit on the Planning Applications Portal.
  2. Select the lodgement type from the available actions for Planning Permit applicant.

Note: If an amended Permit (Section 72 Amendment) includes a condition requiring submission of plans for approval, search for the original Permit number (with a “PL”, “PLN” or “PVN” application reference, rather than “PLA” or “PVA”) when lodging plans.

 

What happens next?

Once we receive plans and landscape bond is paid (where applicable), your endorsement request will be allocated to a planning officer, who will generally review plans within two to three weeks. Endorsed plans will either be sent to the applicant, or advice will be provided requiring further changes to be made if plans do not sufficiently respond to conditions of the permit.

If changes to plans have been made beyond the scope of the conditions of the Permit, we may direct you to lodge an amendment to the permit.
