Proposed Leases to Vodafone Hutchison Australia Pty Ltd and Telstra Corporation Limited of part 36-82 Mitcham Road, Donvale
In compliance with section 115(4) of the Local Government Act 2020 and its Community Engagement Policy, Manningham City Council (‘Council’) hereby gives notice of its intention to enter into leases with:
- Vodafone Hutchison Australia Pty Ltd (‘VHA’); and
- Telstra Corporation Limited (‘Telstra’)
in respect of part of the land known as 36-82 Mitcham Road, Donvale (Donvale Reserve) and invites submissions by any person.
VHA occupies part of the land under an existing lease with Council. The proposed lease comprising approximately 20.95m2 of land (to accommodate the 25m replacement monopole and the existing equipment shelter) is to include:
- the surrender of the unexpired term of the existing lease on 12 February 2022;
- a new lease for a term of 15 years commencing 13 February 2022;
- rent for Year 1 of $29,769.10 plus GST, Year 2 commencing at $19,000 plus GST and for Years 3-15 (inclusive) at the commencement of each of these years, the rent is to be adjusted by 3%; and
- outgoings and standard terms and conditions applicable to a telecommunications facility.
Telstra is to collocate on VHA’s monopole and the lease comprising 30m² of land (for the equipment shelter) is to include:
- a term of 15 years commencing 13 February 2022 or an earlier date by agreement to commence works associated with the installation of the replacement monopole and Telstra’s equipment shelter including the removal of the existing monopole;
- a commencing rent of $15,000 plus GST with 3% annual rent adjustment on each anniversary of the commencement date throughout the term; and
- outgoings and standard terms and conditions applicable to a telecommunications facility.
Any person may make a submission on the proposed leases. Written submissions addressed to the Manager Property Services and posted to Manningham City Council, PO Box 1, Doncaster 3108 or emailed to manningham@manningham.vic.gov.au must be received by 5.00pm on 29 October 2021.
Any person making a submission may request in their submission that they wish to appear in person or be represented by a person specified in the submission to be heard in support of the submission before a committee of the Council at a time and date to be determined.
